ORDER

The petitioner, who was working as a driver in the Tamil Nadu State Transport Corporation (Madurai) Ltd has been dismissed from service on the allegation of unauthorized absence for 10 days. The Industrial Dispute raised by the petitioner has been allowed by the Labour Court, Madurai, by setting aside the order of punishment. Even thereafter, the respondent Corporation has not provided any employment and therefore this petitioner has filed a writ petition, seeking a direction to implement the order of the Labour Court and also sought for wages, under Section 17B of the Industrial Disputes Act. This Court, by its order, dated 26.02.2025 has allowed that writ petition, with a direction to the respondent to implement the order of the Labour Court in I.D.No.9 of 2020, dated 15.06.2024. 2.Now, this petitioner has filed this contempt petition that the above direction of this Court has not been complied with. 2/5

3.The learned counsel appearing for the respondent/Transport Corporation submits that as against the order passed in I.D.No.9 of 2020, dated 15.06.2024, the Transport Corporation has preferred a writ petition in WP.(MD)No.27692 of 2025 and by an order dated 08.10.2025, this Court has also granted an order of interim stay. He further submits that as against the order passed by this Court in WP. (MD)No.4617 of 2025, the respondent/Transport Corporation has also filed a writ appeal, however, with a delay. He also submits that once the writ petition filed by the respondent/Transport Corporation as against the award passed in the industrial dispute has been entertained and the order of interim stay has been granted, then, the workman is entitled for the wages under Section 17B of the Industrial Disputes Act.

4.In view of the above development, this contempt petition is closed with a direction to the respondent/Transport Corporation to pay 17B wages to the petitioner as provided under the Industrial 3/5

Dispute Act. The petitioner is at liberty to prosecute his case in WP. (MD)No.27692 of 2025 and the writ appeal pending before the Division Bench.
