Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarifed Mandamus, to call for the records pertaining to the impugned notice dated 03.06.2025 issued by the first respondent vide letter Ref:SCN/1049257136/25 and quash the same as illegal and consequently direct the first respondent to re-issue passport by processing the application bearing No.MD1075055111725.

ORDER
This writ petition has been filed to quash the impugned notice dated 03.06.2025 issued by the first respondent vide letter Ref:SCN/1049257136/25 and consequential direction to the first respondent to re-issue passport by processing the application bearing No.MD1075055111725. 2.By consent of both parties, this writ petition is taken up for final disposal at the admission stage itself.
3.The learned Government Advocate (Crl. Side) appearing for the second respondent submits that the petitioner has been arrayed as Accused No.2 in Crime No.97 of 2016 registered by the second respondent for offences under Section 7(1)(a)(ii) of Essential Commodities Act r/w 2, 6, 6, 3, 6 and 4 of TNSC Act, dated 19.07.2016. He further submits that the learned 2/5
Judicial Magistrate No.2, Ramanathapuram, has taken cognizance of the aforesaid crime in C.C.No.212 of 2016.
4.Considering the same, there is no scope for granting any relief to the petitioner at this stage. However, it is open to the petitioner to approach the concerned Magistrate Court for appropriate relief to facilitate the first respondent to process his application for issuance of passport. In case, the passport is issued to the petitioner, the same shall be handed over to the learned Judicial Magistrate No.2, Ramanathapuram District, in C.C.No.212 of 2016.
5.Recording the same, this writ petition stands disposed of. There shall be no order as to costs. Consequently, the connected writ miscellaneous petition is closed.
