ORDER

This Criminal Original Petition has been filed seeking a direction to direct the second respondent to file final report (Charge Sheet) in Crime No.1126 of 2019 on the file of the second respondent police within stipulated period.

2.The learned Additional Public Prosecutor (Criminal Side), on instructions, submitted that the investigation is already completed in Crime No.1126 of 2019 and the FIR was closed as 'mistake of fact' and the closure report was filed before the learned Judicial Magistrate No.5, Madurai.

3.The learned counsel for the petitioner would submit that no RCS notice has been served on him.

Crl.O.P(MD)No.13380 of 2020 4.Recording the aforesaid submission, this Criminal Original Petition is closed. Further the respondent police is directed to serve RCS notice to the defacto complainant within a period of two weeks from the date of receipt of copy of this order. The petitioner is at liberty to approach the concerned court by way of protest petition in the manner known to law.
