ORDER

The petitioner has approached this Court seeking a direction to the respondents to release the petitioner's tipper lorry bearing Registration No.TN 72 CC 0110 based on his representation dated 16.05.2025.

2.The learned Counsel for the petitioner submits that the petitioner is the owner of the tipper lorry bearing Registration No. TN 72 CC 0110. The 2nd respondent police called the petitioner and directed him to handover the said vehicle that it is involved in a crime. Therefore, he has handed over the vehicle to the 3rd respondent police station. However the same has not been remanded before any court and hence, the petitioner has approached this Court with the above prayer. 2/5

3.The learned Additional Public Prosecutor appearing for the respondent police submits that the petitioner has voluntarily surrendered the vehicle, since it had involved in a case in Crime No. 653 of 2023 on the file of the Chengamanad Police Station, Kerala. According to him the 3rd respondent police have not registered any case against the said vehicle.

4.Admittedly, no case has been registered either against the petitioner or against his vehicle by the respondent police. Therefore, the 3rd respondent police are not supposed to insist the petitioner to surrender the vehicle. In the event, if the said vehicle is involved in the aforesaid crime in Chengamanad Police Station, it is always open to the Kerala Police to secure the vehicle from the petitioner. Therefore, the 3rd respondent is directed to return the vehicle to the petitioner forthwith.

5.This writ petition is disposed of with the above direction. No costs.
