Order : This criminal miscellaneous petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/s.T.VADIVELAN, Advocate for the petitioner and of Mr.M.VAIKKAM KARUNANITHI, Government Advocate (Crl. side) on behalf of the Respondent, the Court made the following order:- 1/4
This Criminal Miscellaneous Petition has been filed to modify the condition in paragraph No.10(a) imposed upon the petitioner and extend the time granted in Crl.O.P.(MD).No.6853 of 2024, dated 08.05.2024. 2.Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. side) appearing for the respondent police. 3.Considering the submission made by both sides, the condition imposed on the petitioner in paragraph No.10(a) in Crl.O.P.(MD).No.6853 of 2024, dated 08.05.2024 "10(a) the petitioner shall make a non refundable deposit of Rs.
40,000/- (Rupees Forty Thousand Only) to the credit of the Chairman/District Collector, District Mineral Foundation Trust of the concerned District, without prejudice to his defence before the trial Court and the learned Judicial Magistrate, after perusing the challan/receipt, shall accept the sureties furnished by the petitioner" is modified to the effect that "10(a) the petitioner shall make a non refundable deposit of Rs.5,000/- (Rupees Five Thousand Only) to the credit of the Chairman/District Collector, District Mineral Foundation Trust of the concerned District, without prejudice to his defence before the trial Court and the learned Judicial Magistrate, after perusing the challan/receipt, shall accept the sureties furnished by the petitioner". The other conditions passed in the order dated 08.05.2024, made in Crl.O.P.(MD).No.
6853 of 2024, remain unaltered.
4.The Criminal Miscellaneous Petition is ordered accordingly. The time for surrender and execution of sureties is extended by two weeks from the date of receipt of a copy of this order.
