Respondents PRAYER : Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents to grant permission and protection for public meeting as well as to provide welfare assistance to the public on 29.09.2018 at about 05.30 p.m to 10.00 p.m at Obulapadithurai, M.G.R.Thidal, Madurai City based on the petitioner's representation dated 15.09.2018 within a stipulated time as may be fixed by this Hon'ble Court.

ORDER

This writ petition has been filed for a direction to the respondent police to grant permission and police protection for the public meeting that is scheduled to be held on 29.09.2018 at M.G.R.Thidal, Madurai.

2. The learned counsel for the petitioner would submit that a representation was given on 15.09.2018 to the respondent police seeking for permission to conduct the meeting. However, there was no response from the respondent police and therefore the present writ petition has been filed. He would further submit that immediately on the filing of this writ petition a rejection order has been served by the respondent police today.

3. The learned Government Advocate would submit that the respondent police have some problem in giving permission till https://hcservices.ecourts.gov.in/hcservices/

30.09.2018. If the petitioner makes a fresh representation by re scheduling the meeting during the first week of October 2018, the respondent police will consider the same and give necessary permission and police protection.

4. The learned counsel appearing for the petitioner on instructions would submit that the petitioner will re-schedule the meeting on 03.10.2018 in the same venue. He would further submit that a fresh representation to that effect will be given by the petitioner to the respondent police immediately.

5. Taking into consideration, the facts and circumstances of the case, there shall be a direction to the second respondent to grant permission and police protection to the petitioner to conduct public meeting on 03.10.2018 at the venue suggested by the petitioner between 5.30 p.m. to 10.00p.m. The second respondent is at liberty to impose any reasonable conditions for the purpose of conducting the meeting in a peaceful manner without giving rise to any law and order problem. The petitioner is bound to comply with the conditions imposed by the second respondent.

6. The writ petition is disposed of with the above directions. No Costs.
