PRAYER: Civil Revision Petition filed under Article 227 of the Constitution of India, to set aside sale the notice, dated 06.08.2021 made in E.P.No.76 of 2016 in Arb.Case No.174 of 2014 on the file of the Principal District Court, Ramanathapuram. For Petitioners : Mr.R.Murali

This Civil Revision Petition has been filed to set aside the notice, dated 06.08.2021 issued in E.P.No.76 of 2016 in Arb.Case No.174 of 2014 on the file of the Principal District Court, Ramanathapuram.

2.On a perusal of the records show that the petitioners have no right to file the revision against the issuance of notice for proclamation of sale. They have filed this revision petition on the ground that the Execution Court failed to consider that there is a building and valuable weighing machine attached in the first schedule of property. But when they have filed counter in E.P.No.76 of 2016, they have not raised any of the plea set out in this revision. Therefore, the revision petitioners have to file E.A. before the Execution Court to object the description of property or value of the property.
