ORDER

The petitioner, who is an accused in Crime No.257 of 2024, has filed this petition seeking to quash the FIR in Crime No.257 of 2024 1/4

registered against him on the file of the Bodinayakkanur Rural Police Station, for the offence under Sections 354D(1)(i), 506(1) and 509 IPC.

2. When this petition is taken up for hearing, the learned Government Advocate (Crl. Side) submits that the investigation in Crime No.257 of 2024 has already been completed and the final report was also filed before the learned Judicial Magistrate, Bodinayakkanur, through e-filing on 09.09.2024, however, the same is yet to be taken on file.

3. Since it is reported that the investigation in Crime No.257 of 2024 has already been completed and the final report was also filed before the concerned Judicial Magistrate on 09.09.2024, this Court is not inclined to entertain this petition filed to quash the FIR in Crime No.257 of 2024. Accordingly, this petition is dismissed.

4. It is very unfortunate that the final report which was filed on 09.09.2024 is not yet taken on file. The respondent Police claims that the final report is yet to be taken on file. Therefore, the learned Judicial Magistrate, Bodinayakkanur is directed to take the final report without 2/4

any delay, if it is otherwise in order. The respondent Police, who filed the final report, is also having the responsibility to ensure that the final report is taken on file within a reasonable time. Consequently, connected miscellaneous petition is closed.
