Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a Writ of Certiorari to call for the records pertaining to the Impugned Order in Ni.Mu.A4/2987/2020 dated 16/10/2020 on the file of the Respondent No.2 and quash the same as illegal.
ORDER : This petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.T.LAJAPATHI ROY, Advocate for the petitioner and of Mr.K.P.KRISHNADASS, Special Government Pleader on https://hcservices.ecourts.gov.in/hcservices/
behalf of the Respondents 1 to 3, while admitting the Writ Petition, the Court made the following order:- This petition has been filed to grant an interim stay of operation of the order impugned in this writ petition in Ni.Mu.A4/2987/2020 dated 16.10.2020 by the second respondent pending disposal of the writ petition.
2. Heard both sides.
3.The pendency of the writ petition is not a bar for the petitioner to file a revision petition before the appropriate appellate authority. On such filing of the revision by the petitioner, the appellate authority may consider the request of the petitioner after hearing the parties concerned.
4. This Court prima facie finds that there is no justification in granting the interim order as prayed for in this petition and hence this petition stands dismissed as this Court is of the view that the petitioner has got remedy before the appellate authority as contended by Mr.K.P.Krishnadass, learned Special Government Pleader appearing for the official respondents. sd/- 01/12/2020 / TRUE COPY / / /2020 Sub-Assistant Registrar (C.S.)
