PRAYER :- C-38AB. For Anticipatory Bail in Crime No. 158 of 2026 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/Sole Accused, who apprehends arrest at the hands of the respondent for the offences punishable under Sections 296(b), 115(2), 127 and 351(3) of BNS, 2023, in Crime No. 158 of 2026 on the file of the respondent police, seeks anticipatory bail.
2.When the matter was taken up for hearing today, the learned counsel appearing for the petitioner submitted that the petitioner had already filed a bail petition along with a surrender petition before the concerned learned Judicial Magistrate. However, the learned Judicial Magistrate failed to accept the surrender on the ground that the offences are non-bailable offences.

3.However, no documents have been produced by the petitioner to substantiate the above said contention. As per the FIR, the above said offences are bailable in nature and therefore, the question of granting anticipatory bail will not arise and it is not appropriate to consider the anticipatory bail application and the same is not maintainable.
4.Accordingly, this Criminal Original Petition stands disposed of with liberty to the petitioner to approach the concerned appropriate forum by filing appropriate petition in accordance with law.
