Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned undated order passed by the third respondent and quash the same and consequently direct the respondents to give permission to the petitioner to conduct Kabadi Tournament from 29.04.2017 at 07.00 p.m. to 30.04.2017 till 10.00 a.m., at Nattarkulam, Petchiamman Kovil, Thoothukudi District with light and sound.

ORDER

[Order of the Court was made by A.SELVAM, J.] This Writ Petition has been filed under Article 226 of the Constitution of India praying to call for records relating to the impugned order passed by the third respondent and quash the same and also for giving necessary direction to the respondents to give permission for conducting Kabadi Tournament in the place mentioned therein, by way of issuing a Writ of Certiorarified Mandamus. https://hcservices.ecourts.gov.in/hcservices/

2.Mr.K.Guru, learned Additional Government Pleader, has taken notice for the respondents.

3.It is seen from the records that the petitioner has given a representation for the purpose mentioned therein, but the third respondent has rejected the same by way of passing the impugned order, wherein it has been simply stated that due to law and order problem, permission cannot be granted. The reason assigned by the third respondent cannot be accepted and therefore this Court is inclined to pass the following order.

4.In fine, this Writ Petition is allowed in part without costs and the impugned order passed by the third respondent is quashed. The third respondent is directed to look into the representation alleged to have been given by the petitioner afresh and pass suitable orders on merits within a period of two days.
