PRAYER :- For Bail in Crime No.211 of 2022 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/Accused, who was arrested on 11.07.2022 for the alleged offence under Sections 5(1), 5(g) and 6 of Protection of Child from Sexual Offences Act, 2012 and Section 506(1) of IPC in Crime No.211 of 2022, on the file of the respondent police, seeks bail.
2.The case of the prosecution as per the FIR is that the defacto complainant is a aged about 17 years at the time of occurrence. She was in love with A1 as about for a year. On 05.03.2022 at about 9.00 am, the accused abducted her and in a motor room of a garden she was subjected to sexual intercourse and thereafter, continued for a some time. also taken videos and subjected sexual intercourse with the above said victim. By showing the above said videos, the accused persons threatened the victim and continue the subjected sexual intercourse for several times. Based on the above the incident, complaint has been registered.
3. The learned counsel for the petitioner submitted that the petitioner is a close relative of the victim girl and he is ready to marry her.
4. The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioner sexually assaulted the minor victim girl and it is a serious nature of offence and the investigation of the case is pending.
5. Considering the serious nature of offence and that the petitioner abducted the victim girl and continuously subjected sexual intercourse and the same was videographed by the second accused, this Court is not inclined to enlarge the petitioner on bail.
