For Respondent : Mr.A.Thiruvadi Kumar, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory bail in Crime No.91 of 2021 on the file of the Respondent police.

ORDER : The Court made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 147, 148, 294(b), 341, 323, 324 & 506(ii) of IPC, in Crime No.91 of 2021 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 14.06.2021 at about 01.00 p.m., when the defacto complainant was standing in the queue for purchasing ration commodities, the petitioner herein was photographing the women standing in the queue. When the same was questioned by the defacto complainant, the petitioner along with the other accused attacked the defacto complainant and abused him in filthy language. Hence the complaint.

3.The learned counsel for the petitioner submits that the petitioner is an innocent, he has not committed any offence as alleged by the prosecution, but he has been falsely implicated in this case.

4. The learned Additional Public Prosecutor appearing for the respondent, on instructions, submits that this is the second anticipatory bail application and the earlier application filed by this petitioner was dismissed by this Court in Crl.O.P.(MD).No.8850 of 2021 on 06.07.2021.

5. Considering the facts and circumstances of the case, the nature of allegations levelled against the petitioners and also the fact that earlier anticipatory bail application filed by this Petitioner was dismissed by this Court and that there is no change of circumstance, this Court is not inclined to grant anticipatory bail to the petitioners.

6.Accordingly, this Criminal Original Petition stands dismissed.
