PRAYER : Criminal Original Petition filed under Section 482 of the Criminal Procedure Code, to direction to expedite the trial of the criminal case in P.R.C.No. 189/2022 on the file of learned Judicial Magistrate No.V, Tirunelveli, Tirunelveli District within a time frame which may be fixed by this Honourable Court on the facts and circumstances of the case.

ORDER

This criminal original petition has been filed seeking direction to expedite the trial of the criminal case in P.R.C.No. 189/2022 on the file of learned Judicial Magistrate No.V, Tirunelveli, Tirunelveli District within a time frame which may be fixed by this Honourable Court on the facts and circumstances of the case.

2.The petitioner is the defacto complainant in this case. On the basis of his complaint FIR in Crime No.117 of 2022 has been registered for the offences punishable under Sections 147, 148, 341, 294(b), 324, 307, 302, 506(ii) of IPC. After completing the investigation final report has been filed before the learned Judicial Magistrate No.V, Tirunelveli and the same was taken cognizance in P.R.C.No.189 of 2022. So far no committal process has been completed.

3.The learned Government Advocate (crl. Side) would submit that the case was now committed to the Mahila Court, Tirunelveli and the same was numbered as S.C.No.611 of 2022. Hence, the prayer sought for in this petition has become infructuous.

4.In view of the above, this criminal original petition stands dismissed as infructuous.
