No.7552/2016/sa.ba., Dated 06.04.2017 and quash the same on the ground that the same is arbitrary, illegal and without any legal basis and consequently directing the respondent to allow the petitioner to continue in the post of President in R.532 Punjaisangenthi Primary Co-operative Bank, Punjaisangenthi Village.

O R D E R

This Writ petition has been filed by the petitioner for issuance of a Writ of Certiorarified Mandamus, calling for the records relating to the impugned order in his proceedings Na.Ka. No.7552/2016/sa.ba., Dated 06.04.2017 and quash the same on the ground that the same is arbitrary, illegal and without any legal basis and consequently directing the respondent to allow the petitioner to continue in the post of President in R.532 Punjaisangenthi Primary Co-operative Bank, Punjaisangenthi Village.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondent.

3. Mr.R.Karthikeyan, learned Additional Government Pleader, takes notice for the respondent. By consent, the Writ petition itself is taken up for final disposal.

4. It is not in dispute against the impugned order, dated 06.04.2017, the petitioner has a remedy of preferring an appeal under Section 152 (2)(a)(v) of Tamil Nadu Co-operative Societies Act, 1983. Hence, this Writ petition is dismissed on the ground that the petitioner has an effective alternative remedy. However, liberty is preserved to the petitioner to prefer an appeal as provided under Section 152 (2)(a)(v) of Tamil Nadu Co-operative Societies Act, 1983.

No costs.

Consequently, connected Miscellaneous petition is closed.
