This Writ Petition is filed under Article 226 of Constitution of India praying to issue a Writ of Mandamus thereby directing the respondents to delete the Bhoomidhan Boards name from the Patta issued for S.F.No. 123/8A of Karadikkal Group, Thirumangalam Taluk.

O R D E R

This Writ Petition is filed to direct the respondents to delete the Bhoomidhan Boards name from the Patta issued for S.F.No. 123/8A of Karadikkal Group, Thirumangalam Taluk.

2. According to the petitioner, the petitioner is the owner of the property in the S.F.No.123/8A. The property comprised in S.F.No.123/8 measuring an extent of 88 cents of Karadikkal Group Village originally belonged to one Perumal Thevar. Out of this 88 cents, he had gifted 25 cents in favour of Bhoomidhan Board on 29.06.1970, by a registered gift deed. The remaining 63 Cents of land sold to one Pottiammal by a registered sale deed on 06.01.1986. Original S.F.No.123/8 was sub divided as S.F.No.123/8A and https://hcservices.ecourts.gov.in/hcservices/

S.F.No.123/8B and original owner gifted 25 cents in S.F.No.123/8B. While issuing Patta, patta was issued for the entire extent of land was issued in the name of Bhoomidhan Board. Hence, the petitioner has made a representation to the respondents for the relief stated above.

Today, when the matter was taken up for hearing the learned Government Advocate appearing for the respondents submitted that by mistake the patta has been issued for entire land in the name of Bhoomidhan Board. He further submitted that already the fifth respondent made recommendation to the second respondent / District Revenue Officer, by proceedings dated 03.10.2016 to rectify the above said mistake and the same is pending before the second respondent.

In view of above said submission made by the learned Government Advocate appearing for the respondents, the second respondent is directed to consider the recommendation of the fifth respondent and pass suitable orders within a week from the date of receipt of a copy of this order and thereafter, the fifth respondent is directed to issue a patta within a period of twelve weeks.

5. With the above direction, the Writ Petition is disposed of. No costs.
