PRAYER :- For Anticipatory Bail in Crime No.222 of 2025 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioner/A3, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 303(2) of BNS, 2023 r/w. Section 21

(4) of Mines & Minerals (Development & Regulation) Act, 1957 in Crime No.222 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the accused illegally transported 3 1⁄2 units of river sand using a Ashok Leyland vehicle bearing Registration No.TN-45-AT9978. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and has not committed any offence as alleged by the prosecution. The petitioner is merely the owner of the vehicle. He, however, submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court. Hence, he seeks anticipatory bail to the petitioner. 2/4

4. The learned Government Advocate (Criminal Side) submitted that there are totally three accused persons in this case and the petitioner has been arrayed as A3. The petitioner is the owner of the vehicle. He further submitted that A1 and A2 were arrested and are still in custody. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case, and also considering the fact that the FIR was registered on 10.06.2025 and the investigation is at a preliminary stage, and taking note of the fact that the co-accused have been arrested and are still in custody, this Court is not inclined to grant anticipatory bail to the petitioner at this stage.
