For Respondent : Mr.A.Robinson, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- for Anticipatory bail in Crime No.249 of 2019 on the file of the Respondent police ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner, learned Government Advocate(Crl. Side) appearing for the respondent and learned counsel appearing for the intervener. 2.The petitioner is figuring as A1 in Crime No.249 of 2019 registered on the file of the Sessions Court Police Station, Trichy City. The said case was registered at the instance of one Abdul Rahim for the offences under Sections 147, 148, 294(b), 323, 324, 307, 506(ii), 364 and 379 of IPC.

3.It is seen that the petitioner herein had handed over passports to the defacto complainant and also paid him some amount 1/3

for getting visa. But then, the defacto complainant was not able to get the visa.

4.According to the defacto complainant, he had trusted one Vahab and handed over the money as well as the passports to him and that, it was the said Vahab who is evading to fulfill his obligations. Unable to wait any further, the petitioner and others are said to have entered the house of the defacto complainant, beaten him and also abducted him.

5.It is seen that the defacto complainant suffered only simple injury. Even though the petitioner appears to have taken law into his hands, it is obvious that he is an affected person. Therefore, I am inclined to grant anticipatory bail. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate Court No.II, Trichirapalli and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously.

6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
