ORDER

This petition has been filed seeking direction to withdraw and transfer the investigation of the case in Crime no.316 of 2021 on the file of the 2nd respondent herein to 3rd respondent herein or any other competent investigating authority for further and speedy investigation.

2. The learned Government Advocate(Crl.Side) would submit that on the registration of the First Information Report in Crime No.316 of 2021 commenced investigation and enquired the witnesses. Though the anticipatory bail filed by some of the accused have been dismissed by this Court, they are absconding and as such they could not able to secure the accused, however they are about to complete the investigation and the third respondent will file the final report.

3. In view of the above submission, if the investigation is transferred from the file of the second respondent at this juncture,the entire investigation will be affected.

4. Considering the above, the second respondent is directed to complete the investigation and file the final report within a period of twelve weeks from the date of receipt of a copy of this order. The first respondent is directed to monitor the investigation done by the second respondent.

5. With the above direction, the Criminal Original Petition stands disposed of.
