ORDER

This Criminal Original Petition has been filed to direct the first respondent to transfer the investigation of the case in Crime No. 84 of 2019 on the file of the second respondent to some other competent investigation officer other than second respondent and expedite the investigation under the direct supervision of the first respondent.

According to the petitioner based on the complaint given by the petitioner the second respondent registered a case in Crime No.84 of 2019 and thereafter investigation has not been conducted in a proper manner and failed to record the statement from the customers, hence he has filed the present petition to transfer the investigation from the file of the second respondent to any other competent officer. 3.The learned Additional Public Prosecutor appearing for the respondents would contend that already investigation was completed and all the vehicles were recovered and they are ready to file final report. Since already matter has been investigated and charge sheet has also been made ready at this stage transfer of investigate would not arise and the specific allegation given by the petitioner as against the investigation officer is that he has not conducted proper investigation and recorded statements is not correct, hence he seeks dismissal of the petition.

4. Heard both sides and perused the materials available on record.

5. Recording the submission made by the learned Additional Public Prosecutor that now investigation was completed and final report made ready transfer of investigation would not arise, hence the petition is liable to be dismissed.
