O R D E R

This Writ Petition is filed seeking a direction to the respondents 1 to 6 to consider the representation of the petitioner dated 05.06.2023, seeking cancellation of patta No.1162 pertains to the property situated in 2/6

S.No.166/40, in Vadakarai Village, Thirumangalam Taluk, Madurai District that stands in the name of private respondents 7 to 10.

Heard the arguments of Mr.R.Sundar, learned counsel for the petitioner, Mr.M.Gangatharan, learned Government Advocate appearing for the respondents 1 to 5, Mr.M.Vaikkam Karunanithi, learned Government Advocate (Crl. Side), appearing for respondent No.6 and Mr.V.N.Arjun, learned counsel representing Mr.N.Vallinayagam, learned counsel on record for the ninth respondent.

3. According to the petitioner, 4 1⁄2 cents in S.No.166/40 has been in possession and enjoyment of the petitioner for the past 40 years. The private respondents, without having any manner of right, obtained patta in their names in patta No.1162. Therefore, the petitioner submitted a representation before the official respondents on 05.06.2023, seeking cancellation of patta issued in the name of private respondents and the same has not been considered. Hence, the petitioner has come before this Court.

4. The learned Government Advocate appearing for respondents 1 to 5 would submit that the representation submitted by the petitioner will be considered in accordance with law.

5. The learned counsel appearing for the 9th respondent would submit that the official respondents may be directed to consider the representation of the petitioner, after affording reasonable opportunity to the 9th respondent.

In view of the same, without expressing any opinion on the merits of the matter, the first respondent is directed to consider the representation of the petitioner dated 05.06.2023 and pass final orders on its own merits, within a period of twelve (12) weeks from the date of receipt of a copy of this order, after affording reasonable opportunity to the petitioner, private respondents 7 to 10 and other interested parties.

7. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
