Heard the learned counsel on either side.
2.The petitioner's counsel states that she is the owner of the petition mentioned vehicle. The petitioner's husband had used the same and the vehicle was seized as it said to have carried narcotic substance. Seeking release of the vehicle, this writ petition has been filed.
3.The learned Government Advocate informs the Court that the vehicle has been produced before the jurisdictional Court. Therefore, it is for the petitioner to apply for interim custody of the vehicle by filing a petition under Section 451 of Cr.P.C. If https://hcservices.ecourts.gov.in/hcservices/ 1/2
W.P.(MD)No.16860 of 2020 such a petition is filed, the Court below will dispose of the same as early as possible. Granting such liberty to the petitioner, the writ petition is dismissed. I make it clear that I have not gone into the merits of the matter.
4.The petitioner's counsel states that she will file such an application within a period of two weeks from the date of receipt of a copy of this order. In such an event, the Court below shall dispose it of within a period of two weeks thereafter. No costs.
