ORDER

The petitioners with an allegation that the respondent police is harassing them under the guise of an enquiry have approached this Court.

2.The learned Government Advocate(Crl.side) appearing for the respondents 1 & 2 submits that the third respondent herein has lodged a complaint before the second respondent and the same has been treated as petition enquiry in CSR.No.495 of 2025. According to the learned Government Advocate(Crl.side) the allegation is that the petitioners have stolen away coconuts from the third respondent. Though the complainant claimed that there was a theft, in order to ascertain as to whether any civil dispute is pending between the parties, they are conducting petition enquiry. In the event if the petitioner cooperated for the enquiry, they will taken further course of action on the third respondent's complaint. The learned Government Advocate(Crl.side) undertook that the petitioners would not be harassed during the enquiry. 3.This Court has considered the submissions made on either side and perused the available materials.

4.It appears that the third respondent preferred the complaint only on 11.06.2025. The averments of the complaint appears to be theft. However, the respondent Police treating the complaint only as petition enquiry. Therefore, the petitioners are directed to appear before the respondent Police and explain their case. The respondent Police are directed to ascertain the truth in the complaint and to take further course of action. During the course of enquiry, the respondent Police shall not harass the petitioners. Accordingly, this criminal original petition is closed.
