Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents to take action against the third respondent towards recovery of the huge arrears to the tune of Rs.34,52,000/- up to 20.08.2016 pertaining to the third respondent M.S.O.No.11863 at Sathankulam Taluk, Thoothukudi District and to consequentially directing the first respondent to cancel the order dated 10.02.2016 made by the first respondent granting, granting lease to the third respondent as Taluk Cable Operator(LCO 34318) of Sathankulam Taluk by considering the petitioner's representation dated 22.08.2016. O R D E R
This Writ Petition has been filed seeking a direction to the respondents 1 and 2 to take action against the third respondent towards recovery of the huge arrears to the tune of Rs.34,52,000/- up to 20.08.2016 pertaining to the third respondent in M.S.O.No.11863 at Sathankulam Taluk, Thoothukudi District and to consequently directing the first respondent to cancel the order dated 10.02.2016 made by the first respondent, granting lease to the third respondent as Taluk Cable Operator (LCO 34318) of Sathankulam Taluk by considering the petitioner's representation dated 22.08.2016.
2. When the matter came up for hearing today, the learned counsel for the petitioner seeks permission of this Court to withdraw this petition with liberty to challenge the order passed by the first respondent and also he has made an endorsement to that effect, it is stated as follows:- "Permit me to withdraw the Writ Petition with liberty to fresh Writ Petition challenging the TCO order issued in favour of the third respondent."
3. In view of the same, the Writ Petition is dismissed as withdrawn and the liberty is given to the petitioner to challenge the order passed by the first respondent. No costs.
