:Respondents PRAYER: Criminal Original Petition is filed under Section 482 Cr.P.C., to direct the respondent Nos. 3 and 4 not to harass the petitioners under the garb of usurping their powers. For Petitioners : Mr.R.Anand For Respondents : Mr.M.Chandrasekaran, Additional Public Prosecutor.

O R D E R

The learned Government Advocate would submit that there are eight previous cases pending against the first petitioner and the Police had called the petitioner for enquiry with regard to the pending cases.

2.Under the facts and circumstances of the case, the petition not to harass, is not maintainable insofar as the first petitioner is concerned and the same is dismissed against the first petitioner.

3.Insofar as the second petitioner is concerned, she is the wife of the first petitioner. If the respondent Police wants to enquire the second petitioner, the Police have to issue summons to the second petitioner and only thereafter call her for enquiry. It is made clear that the respondent Police shall not harass the second petitioner in the name of enquiry.

4.The criminal original petition is disposed of with the above direction.
