Prayer in CRL A(MD) No. 134/ 2021 To call for the records in Spl.S.C.No.35 of 2016 dated 31.10.2019 on the file of the Learned Mahila Fast Tract Court, Sivagangai and set aside the same.

Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of MR.M.JEGADEESH PANDIAN, Advocate for the petitioner and of MR.RMS.SETHURAMAN, Additional Public Prosecutor on behalf of the Respondent, the court made the following order:- This Criminal Miscellaneous Petition has been filed to condone the absence of the petitioner in complying with the daily condition of appearing before the Fast Track Mahila Court, Sivagangai from 19.05.2021 to 07.09.2021 in pursuance of the condition imposed in Crl.M.P(MD)No.2222 of 2021 in Crl.A(MD)No.134 of 2021, dated 26.03.2021.

CRL MP(MD) No.7061 of 2021 2.The learned counsel appearing for the petitioner submitted that the petitioner is suffering from Hypothyroidism and he has produced some medical records to that effect. Hence he prayed to condone the absence of the petitioner.

3.Mr.RMS.Sethuraman, learned Additional Public Prosecutor appearing for the respondent has strongly opposed for allowing this petition.

4.On perusal of the records, it is reveals that the petitioner is suffering from Hypothyroidism. Considering the health condition of the petitioner, this petition is allowed and the petitioner shall appear before the concerned Court daily at 10.30 a.m. for a period of 30 days and thereafter the petitioner shall appear before the concerned Court on the first working day of every month at 10.30 a.m. until further orders.
