ORDER : The Court made the following order :- 1/3

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 191(2), 191(3), 126(2), 296(b), 115(2), 118 (1), 351(3), 49 of BNS 2023 in Crime No.274 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that there was a land dispute between the 5th accused and the defacto complainant, as a result of which, the petitioner along with other accused persons have abused the defacto complainant in filthy language and attacked him with iron rod and caused injuries. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that the petitioner is not present in the scene of occurrence and he is ready and willing to abide by any conditions which may be imposed by this Hon'ble Court. Hence, he seeks anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal Side) submitted that there are four previous cases pending against the petitioner and the investigation is still pending and co-accused had already been arrested and remanded to judicial custody. Hence, he opposed for grant of anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case and also the fact that the investigation is at initial stage and also considering the fact that co-accused had 2/3

already been arrested and remanded to judicial custody and there are four previous cases pending against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
