Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the 2nd respondent to fix the four boundaries of the property comprised in Survey No.49, 145, Ward No.5, Block 83, 91 on the basis of the petitioner's representation, dated 20.08.2016 within the stipulated period.

ORDER

Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the respondents.

2. By consent, the Writ Petition itself is taken up for final disposal.

3. According to the petitioner, he made an application to the second respondent to survey and fix boundaries of his land. Pursuant to the petitioner's application, the second respondent also issued notice to the petitioner as well as the rival claimants for measuring the land on 22.08.2016. petitioner, the contesting parties are not co-operating for the survey.

4. In the said circumstances, the second respondent is directed to serve a proper notice to the rival claimants and take steps to measure the property. If the rival claimants are not co-operating, the second respondent is directed to proceed with the survey and fix boundaries, as per the revenue records. Such exercise shall be completed within a period of six weeks from the date of receipt of a copy of this order.

With the above direction, this Writ Petition is disposed of. No Costs.
