PRAYER :- To enlarge the petitioner on bail in connection with the case in S.C.No.97 of 2018 on the file of the Sessions Judge, Fast Track Mahila Court, Dindigul.

ORDER : The Court made the following order :- The petitioner/sole accused herein was arrested and remanded to judicial custody on 07.06..2023 for the alleged offence under Sections 366 and 376(1) of IPC in Crime No.257 of 2008 on the file of the respondent police seeks bail.

2. Earlier the petitioner was arrested and released on bail. Thereafter the petitioner did not appear before the trial Court , hence Non Bailable Warrant was issued on 22.08.2022. The petitioner was arrested on execution of Non Bailable Warrant on 07.06.2023.

3. It is seen that the petitioner had committed rape on the minor victim girl. The case is of the year 2008 and only because of the non appearance of the petitioner the trial got delayed and taken cognizance in the year 2018. Thereafter the petitioner did not appear before the trial court on 22.08.2022 as such Non Bailable Warrant was issued against him and the petitioner was arrested and remanded to judicial custody on 07.06.2023. If the petitioner is released on bail he will abscond again and the entire trial will be stalled, therefore this Court is not inclined to grant bail to the petitioner.

4. Hence the petition stands dismissed.
