ORDER : The Court made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under sections 417, 420, 294(b) and 506(i) IPC in Crime No.6 of 2023 on the file of the respondent police, seeks anticipatory bail. 1/3
2. The case of the prosecution is that the petitioner herein and other accused have advised the defacto complainant to deposit some amount in stock market and he will get more money in return. Believing the same, the defacto complainant has also given a sum of Rs.2,50,00,000/- to the first and second accused. Thereafter, they did not return the amount. Hence, a case has been registered.
3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and he has not committed any offence as alleged by the prosecution and his name has been falsely implicated in this case. He would further submit that co-accused already released on bail and seeks anticipatory bail.
4. The learned Additional Public Prosecutor appearing for the respondent Police would submit that the transaction amount involved in this offence is very huge and hence, the custodial interrogation of the petitioner is very much necessary and he strongly opposed to grant anticipatory bail to the petitioner.
5. Considering the serious nature of allegations made against the petitioner and also the submission made by the learned Additional Public Prosecutor appearing for 2/3
the respondent that the custodial interrogation of the petitioner is necessary, this Court is not inclined to grant anticipatory bail to the petitioner.
