O R D E R
On instructions, learned Counsel appearing for the fourth respondent would submit that both the petitioner as well as the fourth respondent have been promoted to a higher post. He would submit that the petitioner has been promoted to the post of Attender / Junior Clerk and the fourth respondent has been promoted to the post of Clerk. Therefore, learned Counsel for the fourth respondent submits that the prayer sought for in this Writ Petition has now become infructuous.
2.Since the prayer sought for in this Writ Petition has been achieved by the petitioner, since he has been promoted to the post of Junior Clerk, this Court is of the considered view that this Writ Petition has become infructuous. Learned Counsel for the petitioner is also unable to get instructions with regard to the submissions made by the learned Counsel for the fourth respondent as recorded by this Court supra. Therefore, this Court has to believe the statement made by the learned Counsel for the fourth respondent. 3/6
3.In view of the fact that the consequential prayer sought for by the petitioner in this Writ Petition having been achieved, this Writ Petition is dismissed as infructuous.
