ORDER

This Criminal Original Petition has been filed to direct the 2nd respondent not to harass the petitioner in the guise of enquiry by considering the petitioner's representation dated 20.06.2023.

2. The learned Additional Public Prosecutor would submit that the case in Crime No.311 of 2011 was registered for the offences punishable under Sections 457 and 380 of IPC. During the course of the above said investigation, involvement of this petitioner is also suspected. Only on that ground, summon has been issued to the petitioner.

3. The learned counsel for the petitioner would submit that the petitioner also appeared before the second respondent Police, but so far investigation has not been completed and no details are furnished to him, to show his involvement.

4. The second respondent Police is present before this Court and stated that there is no clue in the above said investigation process. There 2/4

is only suspicious against this petitioner, since he is already involved in the case in Crime No.4 of 2017, which was also taken cognizance in S.C.No.27 of 2019, the petitioner was shown as third accused and later he was acquitted by the Principal Sessions Judge, Sivagangai on 23.12.2022.

5. The petitioner is directed to appear before the second respondent and co-operate with him to complete the process of investigation. If any trouble arises during the course of investigation, he can workout his remedy through appropriate proceedings.

4. With the above said direction, this Criminal Original Petition stands disposed of.
