O R D E R

The petitioner/A2 in PRC No.49 of 2024, on the file of the learned Judicial Magistrate, Sivagiri, Tenkasi has approached this Court, to quash the above proceedings as against her.

2. The case of the prosecution is that this petitioner is the wife of the deceased and they are having two male children. This petitioner had extramarital affair with one Mariselvam, who is A1 in this case. The deceased has warned both of them, however, they continued their relationship. On the date of occurrence, there was a wordy altercation between the petitioner and the deceased. Due to the conduct of the petitioner and A1, the deceased committed suicide by hanging. Therefore, the case has been registered as against this petitioner along with A1.

3.The learned counsel for the petitioner submits that there is no material for attracting the offence under Section 306 IPC as against this petitioner. Therefore, the proceedings as against this petitioner may be quashed.

4.Mr.A.S.Abul Kalaam Azad, learned Government Advocate (Crl.side) takes notice for the first respondent and submits that there are two eyewitnesses, who speak about the manner, in which, this petitioner along with A1 have abused the deceased, driving him to commit suicide. The grounds raised by the petitioner is a matter for trial.

5.In view of the objections raised by the learned Government Advocate (Crl.side), this Criminal Original Petition is dismissed with liberty to the petitioner to raise all her grounds before the trial Court. Consequently, connected Miscellaneous Petitions are closed.
