ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police for the offences punishable under Sections 366(A) @ 363 of IPC and 5(1) r/w 6 of POCSO Act 2012, in Crime No.48 of 2018. He seeks bail.
2.The learned counsel for the petitioner would submit that the petitioner was arrested and remanded to judicial custody on 06.09.2018. He further submitted that there was a love affair between the petitioner and the victim girl.
3.The learned Government Advocate (Criminal Side) would submit that the victim has already given 164 statement before the learned District Munsif cum Judicial Magistrate, Alangudi and produced a copy of the statement before this Court.
4.It is seen from the said statement given by the victim that there was already a relationship between the petitioner and the victim girl and as a result of the same both of them had gone from Dindigul to Erode and stayed out side for two days. Now that the 164 statement has been taken from the victim girl and the investigation is almost complete in this case, this Court deems it fit to grant bail to the petitioner by imposing certain conditions: https://hcservices.ecourts.gov.in/hcservices/
(i) the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties, each for a like sum to the satisfaction of the learned Mahila Court, Pudukottai.
(ii)the petitioner shall appear before respondent police as and when required for interrogation.
