This case came up for settlement before the Lok Adalat. Both the parties present. The counsel for the
appellant/s MR.V.SAKTHIVEL and the counsel for the respondent/s MR.L.PRABAKARAN are present. After mutual discussion, negotiation, mediation and conciliation between both parties and with the assistance of the Bench, both sides consented for settlement. AWARD After negotiation between the parties, this matter is settled as Rs.20,00,000/-[Rupees Twenty Lakhs Only], as full quit. The appellant/Insurance Company has already deposited a sum of Rs.17,17,384/- (Rupees Seventeen Lakhs Seventeen Thousand Three Hundred and Eighty Four only). The appellant is directed to deposit the remaining amount of Rs.2,82,616/-(Rupees Two Lakhs Eight Two Thousand Six Hundred and Sixteen only), within a period of four weeks from the date of receipt of a copy of this order.
On such deposit being made, the first respondent/claimant is permitted to withdraw a sum of Rs.15,00,000/- (Rupees Fifteen Lakhs only) without filing any formal permission petition and the third respondent, who is a minor claimant, his share amount of Rs.5,00,000/-(Rupees Five Lakhs only) is to be deposited in any one of the nationalized bank, till attaining majority and the 1st claimant is permitted to withdraw the interest amount of the deposited amount of the minor claimants, once in three months. The claimants 1 and 3 are permitted to withdraw the accrued interest in the deposited amount.
