Mr.M.Karunanithi Government Advocate (Criminal Side) For Intervenor : Mr.R.Mathava Selvam ORDER : The Court made the following order :- This petition has been filed to modify the condition imposed on the petitioners in Crl.M.P.No.136 of 2025 dated 22.05.2025, on the file of the Principal District Sessions Judge, Madurai.

2. The learned counsel for the petitioners submitted that the petitioners have already settle the loan amount to the defacto complainant. Further, the defacto complainant has lodged a present complaint and demanded money from the petitioners. Hence, he prays for modification of the said condition.

3. The learned Government Advocate (Criminal Side) appearing for the respondent police have raised strong objection to allow this petition stating that the petitioners already executed the document and admitted the liability of the amount of Rs.24,60,000/-.

4. The learned counsel for the Intervenor submitted that the petitioners have received a sum of Rs.27,40,000/- from the defacto complainant and agreed to return an amount of Rs.24,60,000/-. Further, the petitioners had returned only a sum of Rs.5,00,000/- and balance amount of Rs.19,60,000/- is not paid till date. Hence, he prays for dismissal of this petition.

5. Considering the facts and circumstances of the case and also objection raised by the learned Government Advocate (Crl.Side) and also the learned counsel for the Intervenor and considering the condition imposed by the trial Court is not onerous, this Court is not inclined to allow this petition.

6. Accordingly, this Criminal Original Petition is dismissed and connected Crl.MP(MD).No.9356 of 2025 is closed.
