O R D E R

This writ petition has been filed to quash the impugned order dated 06.11.2015 passed by the third respondent and consequently direct the respondents to approve the appointment of one J.Pravin in the petitioner's school from the date of his appointment.

2.Heard the learned counsel appearing for the petitioner and the learned Special Government Pleader, who takes notice for the respondents. By consent the writ petition itself is taken up for final disposal at the admission stage.

3.It is the case of the petitioner that the impugned order has been passed by the third respondent, which ought to have been passed by the first respondent and that, this mistake has occurred in view of the order passed by this Court in WP(MD) No.13420 of 2015, which did not specify the respondent, as to who has to consider the representation of the petitioner and pass orders. The third respondent who passed the impugned order was also a party in WP(MD)No.13420 of 2015. The circumstances leading to the filing of the present writ petition are as under: The petitioner school has sent a representation on 05.12.2015 to the second respondent who was the competent authority to approve the post of Vocational Instructor in the petitioner school and to approve appointment of one J.Pravin. As there was no response, WP(MD)No.13420 of 2015 was filed and in which, the said direction was issued without specifying the respondent by whom order has to be passed.

As the third respondent had passed the orders on the representation and contending that it is only for the first respondent to pass orders, this writ petition has been filed. 5.It is not in dispute that the competent authority is only the first respondent and not the third respondent. Therefore, the order passed by the third respondent is hereby set aside and the first respondent is directed to consider the representation of the petitioner and to pass orders on merits and in accordance with law within a period of four weeks from the date of receipt of a copy of this order.

6.The Writ Petition is disposed of with the above direction. No costs. Consequently, connected WMP(MD)No.13171 of 2016 is closed.
