: Respondents Prayer: This Writ Petition is filed under Article 226 of Constitution of India praying to issue a Writ of Mandamus directing the respondents to effect sub-division in S.No.403/2 and grant patta to the petitioner and his brother for a total extent of 8269 Sq.feet situated in Old Survey No.403/2, New. Survey No.403/2A with corresponding UDR Survey Number. 403/2A3 at Kothaimangalam Village, Palani Taluk, by considering his representation dated 01.09.2016.

The petitioner has filed the present Writ Petition to direct the respondents to effect sub-division in S.No.403/2 and grant patta to the petitioner and his brother for a total extent of 8269 Sq. Feet situated in Old Survey No.403/2, New. Survey No.403/2A with corresponding UDR Survey Number. 403/2A3 at Kothaimangalam Village, Palani Taluk, by considering his representation, dated 01.09.2016.

2. The petitioner and his brother jointly purchased the property in the year 2010 and subsequently, the patta was also transferred in their name. Now, they found that the patta stands in their name was transferred in the name of the third party. Hence, the petitioner made an application dated 01.09.2016, before https://hcservices.ecourts.gov.in/hcservices/

the respondents to grant patta in their name and the same is pending.

3. Since the petitioner application is pending, the 2nd respondent are directed to conduct an enquiry, based on the application given by the petitioner dated 01.09.2016 and after issuing notice to the rival claimants and affording an opportunity of hearing, pass an orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order.

The Writ Petition is disposed of with the above direction. No costs.
