For R-1 : M/s.M.Anandha Devi, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For an Anticipatory Bail in Crime No.400 of 2020 on the file of the Respondent police.

ORDER : The Court made the following order :- The petitioner, who is arrayed as A1, apprehending arrest at the hands of the respondent police for the offences punishable under section 381 of IPC, in Crime No.400 of 2020 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner and others have stolen the mosquito net worth about Rs.50 lakhs from the defacto complainant's company and sold the same to one Sarvesh at Salem. Hence, the present complaint.

3.Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondent.

4.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.13426 of 2020 prosecution and he has been falsely implicated in this case. The petitioner is not having any bad antecedent and hence, he prayed for grant of anticipatory bail to the petitioner. 5.The learned Government Advocate (Crl. Side) appearing for the respondent police submitted that the petitioner along with other accused persons have stolen the mosquito net worth about Rs.50 lakhs. He further submitted that earlier this Court has dismissed the anticipatory bail application, by order dated 02.11.2020, in Crl.O.P.(MD).No.11952 of 2020. While that being so, the petitioner suppressing the above said fact, approached this Court for anticipatory bail.

6.Considering the facts and circumstances of the case and also considering the fact that the petitioner suppressing the above said facts, approached this Court for anticipatory bail, this Court is not inclined to grant anticipatory bail to the petitioner. 7.Accordingly, this criminal Original petition is dismissed. sd/- 26/11/2020 / TRUE COPY / / /2020 Sub-Assistant Registrar (C.S.)
