: Respondents Prayer: This Writ Petition is filed under Article 226 of the Constitution of India for issuing a Writ of Certiorarified Mandamus to call for the records relating to the impugned order passed by the respondent in his proceedings in Na.Ka.No.113/H/2015-16/FM, dated 25.01.2016 and quash the same and consequently, direct the respondent herein to permit the petitioner to discharge his duties as Factory Manager in the respondent mills.

ORDER

This Writ Petition has been filed seeking to call for the records relating to the impugned order passed by the respondent in his proceedings in Na.Ka.No.113/H/2015-16/FM, dated 25.01.2016 and quash the same and consequently, direct the respondent herein to permit the petitioner to discharge his duties as Factory Manager in the respondent mills.

2. Today, when the matter was taken up for hearing, the learned counsel appearing for the petitioner submitted that pending Writ Petition, an order has been passed initiating disciplinary proceedings against the petitioner. Therefore, he seeks liberty to approach the appropriate authority to challenge the aforesaid order.

3. In view of the said submission, this Writ Petition is dismissed as infructuous. However, the petitioner is given liberty to challenge the said order before the appropriate forum in the manner known to law. No costs. Consequently, connected Miscellaneous Petition is closed.
