Petition is filed under section 482 of Criminal Procedure, to direct the III Additional District and Sessions Judge (PCR Cases), Madurai, to consider the bail application of the petitioners on the same day of their surrender in crime No.1728 of 2020, on the file of the second respondent police.
ORDER:- This Petition coming on for hearing on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.M.Mahendran, Advocate for the Petitioner and of Mr.V.Neelakandan, Additional Public Prosecutor, for the respondents 1 and 2, this Court made the following order: 1/3
This criminal miscellaneous petition has been filed to extend the time having been granted by this Court in Crl.O.P(MD). No.12100 of 2020 dated 22.10.2020 for surrendering of the petitioners in pursuance of the order of this Court for another 15 days.
2.The learned counsel for the petitioners would submit that they were not able to arrange the sureties within the time frame as stipulated in Crl.O.P.(MD)No.12100 of 2020. Moreover, due to financial crises, they are unable to produce the surety before the Court below. Therefore, they seek further extension of 15 days time to comply the order of this Court.
3.Heard the learned counsel appearing on either side. 4.Considering the facts and circumstances of the case and also considering the submission made by the learned counsel for the petitioners, this petition is ordered and the time granted to the petitioners to surrender before the concerned Court is extended by 15 days from the date of receipt of a copy of this order.
