ORDER
This petition has been filed to direct the respondent police herein to provide necessary police protection to the life and limb of the petitioner and to the poultry farm in the name and style of 'Sathya business groups' based on petitioner's representation dated 08.11.2020.
2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor (Criminal Side) for the official respondents.
3.The learned counsel for the petitioner would submit that the petitioner and his friends namely Subbash, Sanu and Bineesh entered into a lease deed with the 3rd respondent herein for running a poultry farm in the property owned by the 3rd respondent situated at S.No.651/6 with an extent of 1 acre 75 cents, by a registered document No.2544/2019 dated 25.03.2019 for a consideration of Rs.4,00,000/-. The lease period starts from 25.03.2019 to 25.03.2024. In this circumstances, the 3rd respondent frequently came 1/3
to the poultry farm and threatened the petitioner to vacate the premises stating that the lease amount is much lower. According to the petitioner, due to COVID-19 pandemic situation, the petitioner and other employees were not in a position to stay at the poultry farm and went to Kerala. At that time, the 3rd respondent forcibly entered into the poultry farm on 27.07.2020 and attacked the supervisor. Hence, complaint has been lodged before Veerapandi Police Station on 06.08.2020 and the 2nd respondent police also conducted enquiry and the 3rd respondent has given undertaking that she will not enter into the poultry farm. Eventhen, without adhering the undertaking given by her, she again forcibly entered into the poultry farm and threatened the petitioner with dire consequences. Hence, the petitioner has made a complaint before the respondent police on 09.11.2020 seeking police protection. Since no action has been taken by them, the petitioner is before this Court, with the present Criminal Original Petition.
4.The learned Additional Public Prosecutor,(Crl.side) on instructions, would submit that, based on the complaint enquiry was conducted and during the enquiry, both the parties were present and stated that they amicably settled the matter and prayed not to proceed with the complaint, accordingly the enquiry was closed on 12.12.2020.
5.Recording the above submission made by the learned Additional Public Prosecutor, this Criminal Original Petition is closed. If the petitioner is still aggrieved, he is at liberty to approach the appropriate Civil Forum for his remedy and the police will not interfere with the above matter.
