PRAYER: Writ Appeal filed under Clause 15 of the Letters Patent praying this Court to set aside the order made in W.P.(MD)No.2013 of 2020, dated 23.02.2020 dismissing the writ petition and consequently, direct the respondents to provide any post under the compassionate ground to the petitioner without insisting to pass 8th standard within a time frame as may be fixed by this Court.

JUDGMENT

(Judgment of the Court was made by G.R.SWAMINATHAN, J.) The appellant's father Selvaraj was employed as Masdoor in TANGEDCO. He passed away on 02.05.2013 while in service. The appellant submitted application for appointment on compassionate ground. Since it was not processed, the appellant filed W.P.(MD)No. 9029 of 2018. Pursuant to the direction given by this Court, the application submitted by the appellant was considered and rejected on the ground that she did not possess minimum educational qualification prescribed for appointment in TANGEDCO. Challenging the said 2/5

rejection order dated 19.09.2019, W.P.(MD)No.2013 of 2020 came to be filed. The learned single Judge dismissed the writ petition vide order dated 23.02.2022 on the ground that the scheme of compassionate appointment has to be strictly applied and since the petitioner did not clear 8th standard which is the minimum educational qualification, she was not eligible for any compassionate appointment. Challenging the same, this appeal has been filed.

2. It is seen that during the pendency of this writ petition, the petitioner had passed 8th standard. Copy of the mark sheet has been enclosed in the typed set of papers.

3. Considering this subsequent development, we set aside the order impugned in the writ petition as well as the order passed by the learned single Judge. The respondents are directed to include the appellant in the list of persons chosen for compassionate appointment. The appellant's seniority will be reckoned with effect from December 2021. As and when the appellant's turn comes, she will be granted suitable employment.
