O R D E R

This Writ Petition is filed seeking a direction to the respondents 2 and 3 to cancel the patta issued in the name of 5th respondent and restore the patta to its original position in respect of the property situated in Survey Nos.341/14 and 341/15, Manamadurai Group, Manamadurai Town, Sivagangai District, by considering the petitioner's representation dated 25.05.2023.

2. Heard the arguments of Mr.A.R.Kannappan, learned counsel for the petitioner, Mrs.S.Jeya Priya, learned Government Advocate appearing for the respondents 1 to 3, and Mr.R.Senthilkumar, learned counsel appearing for the respondent Nos.4 and 5.

3. According to the petitioner, his father Vellaichamy and 4th respondent's father Chokkalingam are entitled to 2 1⁄2 cents of land in Old S.No.341/2A 10 [New S.No.341/16] and Old S.No.341/2A 9 [New 2/6

S.Nos.341/14 and 341/15 respectively]. During updation of revenue records, the 4th respondent's father Chokkalingam was given patta for excess land. Therefore, the petitioner filed an application before the Revenue Divisional Officer, Sivagangai seeking rectification of revenue records. The Revenue Divisional Officer passed an order stating that the petitioner's father Vellaichamy is entitled to 0.01.16 ares of land in S.No. 341/16 and the 4th respondent's father Chokkalingam is entitled 0.01.16 ares of land in S.Nos.341/14 and 341/15. He also further directed the parties to move the revenue authorities for rectification of revenue records after disposal of the civil suits in O.S.Nos.127/2018, 127/2018 and 60 of 2019, pending on the file of Principal District Munsif Court, Manamadurai.

In the meantime, while the civil suits were pending, the 5th respondent, who is the son of 4th respondent, moved the revenue Divisional Tahsildar and got patta mutation in his favour. Aggrieved by the same, the petitioner submitted the instant representation dated 25.05.2023, seeking cancellation of patta issued in the name of 5th respondent. The same has not been considered. Hence, the petitioner has come before this Court.

4. The learned Government Advocate appearing for respondents 1 3/6

to 3 would submit that the representation of the petitioner will be considered in accordance with law.

5. The learned counsel appearing for the respondents 4 and 5 would submit that the revenue officials may be directed to afford reasonable opportunity to the 5th respondent before passing any order on the representation submitted by the petitioner.

In view of the same, without expressing any opinion on the merits of the matter, the third respondent is directed to consider the representation of the petitioner dated 25.05.2023 and pass final orders on its own merits, within a period of eight (8) weeks from the date of receipt of a copy of this order, after affording reasonable opportunity to the petitioner and the 5th respondent.

7. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
