ORDER

This Writ Petition filed to direct the 1st to 3rd respondents to take necessary action against the 4th and 5th respondents on the basis of the petitioner's complaint dated 24.05.2023, 21.06.2023, 22.06.2023.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents 1 and 2.

3. The learned Additional Public Prosecutor would submit that on the basis of the complaint given by the petitioner, enquiry was conducted and closed on 16.06.2023 and RCS notice is going to be served upon the petitioner.

4. The learned counsel for the petitioner would submit that it is the serious issue that only on the basis of the money transaction, the petitioner has executed the above said sale deed, but using of the above said sale deed, the fourth respondent has entered into the property and made trouble. Only on that ground, the petitioner made a complaint.

5. The learned Additional Public Prosecutor would further submit that during the course of enquiry, both parties appeared and at that time, the petitioner stated that he will repay the entire amount to the counter party and get the sale deed retransferred to him. Both parties stated that they will workout their remedy through civil process. On the basis of the above said undertaking, the above said complaint was closed.

6. Even though request was mae by the learned counsel for the petitioner for re-enquiry, there is no question of re-enquiry here. The petitioner is at liberty to workout his remedy through appropriate civil process.

7. With the above liberty, this Writ Pettiion stands disposed of. No costs.
