PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondents 1 to 4 to consider the Petitioner's representation, dated 10.6.2025 and consequently to direct the respondents to issue patta in favour of Petitioner in S.No.8/3 at Block NO.7, Ward XXI, Madakulam Revenue Village, Thiruparamkundram Taluk, Madurai District within the time stipulated by this Court.

The Writ Petition is filed seeking a direction to the respondents 1 to 4 to consider his representation, dated 10.6.2025 and consequently direct the respondents to issue patta in his favour in respect of S.No.8/3 at Block NO.7, Ward XXI, Madakulam Revenue Village, Thiruparamkundram Taluk, 2.Heard the learned counsel appearing on either side and perused the materials placed before this Court. 2/6
3.According to the Petitioner, her father purchased 1 acre 72 cents in R.S.No.450/2 in Madakulam Village, Madurai South Taluk, Madurai District. The said survey number is now assigned with new S.No.8/2 and 8/3.The Petitioner's father executed three settlement deeds in favour of Petitioner and settled the subject property in her favour in the year 2004. The southern portion of the property settled in favour of the Petitioner with S.NO.8/3 is classified as ''Pathway''. On the objection submitted by the Petitioner, the fifth respondent conducted an enquiry and pass orders on 23.4.2004 for removal of the entry in the revenue records depicting S.No.8/3 as 'pathway'. Inspite of the same, necessary amendment has not been carried out in the revenue records. Therefore, the Petitioner submitted the instant representation on 10.6.
2025 before the first respondent with a copy marked to the other respondents, seeking deletion of entry in the revenue records, as if the subject property is a 'street' and issue of patta in the name of Petitioner. The same has not been considered so far. Hence the Petitioner has come before this Court with present Writ Petition for the relief stated supra.
4.M.Gangatharan, learned Government Pleader who appears for the respondents 1 to 5 produced the TSLR Register for 3/6
the subject property.
5.A perusal of the same would show that the name of the Petitioner's father has been entered in Column no.17 of TSLR Register. However, in Column No.6 and 7, the subject property is described as 'Sarkar Manai' and in Column NO.18, it is described as 'Street'. If it is a street, it is not known as to how the name of the Petitioner's father has been included in Column No.17. 6.In such circumstances, without expressing any opinion on the merits of the matter, the third respondent is directed to consider the representation of the Petitioner, dated 10.6.2025 and pass final orders on its own merits after issuing notice to the Petitioner and local authority namely, the Madurai Corporation, within a period of 12 weeks from the date of a copy of this order. 7.With the above directions, the Writ Petition stands disposed of. No costs.
