For Intervenor : Mr.Balamurugapandi, Advocate For Respondent : Mr.KR.Bharathi Kannan, Government Advocate (Criminal Side) PETITION FOR ANTICIPATORY BAIL Under Section 438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.469 of 2020 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioners/A1 and A3, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 447, 294(b), 323,324 and 506(ii) of IPC seek anticipatory bail. 2.The case of the prosecution is that due to previous enmity the petitioners herein along with other accused said to have abused the defacto complainant, assaulted him and also threatened him with dire consequences.

3.The learned counsel for the petitioners would submit that the petitioners are innocent and a false case has been foisted against them. He would also submit that the injured sustained only simple injuries.

4.The learned counsel for the intervenor would submit that earlier the petitioners have approached the learned Principal District and Sessions Judge, Ramanathapuram for anticipatory bail and the learned Sessions Judge has granted anticipatory bail with a condition to stay away from Ramanathapuram, suppressing the same, the present petition has been filed.

5.The learned Government Advocate(Criminal Side) would submit that the injured sustained only simple injuries . 6.Taking into consideration the facts and circumstances of the case and also taking note of the fact that the injured sustained only simple injuries this Court is inclined to grant anticipatory bail to the petitioners with certain conditions. 7.Accordingly, the petitioners are ordered to be released on bail in the event of arrest or their appearance, within a period of fifteen days from the date of receipt of a copy of this order, before the learned Judicial Magistrate No.I, Ramanathapuram on condition that the petitioners shall execute a bond for a sum of Rs.

(b)the petitioners shall stay at Madurai and report before the Tallakulam Police Station daily at 10.30 a.m., and 5.30 pm., for a period of four weeks and thereafter as and when required for interrogation.

(c)the petitioners shall not tamper with evidence or witness either during investigation or trial;

(d)the petitioners shall not abscond either during investigation or trial;

(e)on breach of any of the aforesaid conditions, the learned Magistrate/ Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005) AIR SCW 5560]; and;

(f)if the accused thereafter absconds, a fresh FIR can be registered under Section 229-A IPC.
