Prayer in CRL OP(MD). 22354/ 2018 :

Criminal Original Petition filed under section 482 of Criminal procedure code, to direct the respondent to complete the investigation and to file a final report in Cr.No.96/2012 on the file of the respondent.

O R D E R

This Contempt Petition has been filed to punish the respondent herein for making false statement and his wilful disobedience of the order passed by this Court in Crl.O.P.(MD). No.22354 of 2018, dated 19.12.2018.

2. Today, when the matter is taken up for hearing the learned Government Advocate (Crl. Side) would submit that the respondent has conducted investigation and closed as 'Mistake of Fact' in Crime No.96 of 2012.

3. The learned counsel appearing for the petitioner would submit that after submission of the respondent in Crl. O.P.(MD) No.22354 of 2018, dated dated 19.12.2018 the same was closed and thereafter, he filed copy application before the concerned jurisdictional Magistrate it was returned as no final report was filed.

4. In such circumstances, the respondent police is directed to file the referred charge sheet before the concerned jurisdictional Magistrate after serving copy of the same to the defacto complainant.

5. With the above observations, the Contempt Petition is closed.
