ORDER
This writ petition is filed seeking issuance of writ of mandamus forbearing the respondents 1 to 5 from disbursing the compensation amount payable to the land owners in respect of the properties situated in Survey Nos.236/1A1, 236/1A2, 237/8B, 236/1B, 263/1A, 263/1B and 263/3B, in West Mudukulathur Village, Mudukulathur Taluk, Ramanathapuram District, to the respondents 6 to 18 behind the back of the petitioner.
2.Heard the arguments of Mr.J.Barathan, learned counsel appearing for the petitioner and Mrs.K.Malathi, learned Additional Government Pleader appearing for the respondents 1 to 5. Since no adverse order is passed against the respondents 6 to 18, notice to them is dispensed with.
3.According to the petitioner, the subject property belonged to his father, Arumugam. The petitioner claims himself as son of the second wife of Arumugam. The private respondents are the children of first wife of Arumugam. In his capacity as one of the legal heirs of Arumugam, the petitioner claims share in the compensation amount fixed for the acquired lands in the above mentioned survey numbers. Therefore, he submitted a representation before the fifth respondent requesting him not to disburse the compensation amount to the private respondents without notice to the petitioner. The same has not been considered. Hence, the petitioner has come before this Court. 4.The petitioner claims share in the compensation amount mainly on the ground that he is son of deceased Arumugam. The request made
by the petitioner shall be considered in the light of Section 21 of Tamil Nadu State Highways Act. Hence, the fifth respondent is directed to forward the representation of the petitioner dated 15.02.2022 to the first respondent herein within a period of two weeks from the date of receipt of a copy of this order. On receipt of the representation of the petitioner from the fifth respondent, the first respondent shall consider the same in the light of Section 21 of Tamil Nadu State Highways Act and pass final orders on its own merits, within a further period of twelve weeks from the date of receipt of a copy of this order, after giving due opportunity to the petitioner and the private respondents 6 to 18. Accordingly, this Writ Petition is disposed of. No costs.
