ORDER

This Criminal Original Petition has been filed seeking a direction to the learned Judicial Magistrate, Aruppukottai, to dispose of Cr.M.P.No.757 of 2023 within a stipulated time by this Court. The above said petition was filed by the petitioner under Section 125 of Cr.P.C., seeking an order to recovery of maintenance amount.

2. According to the learned counsel for the petitioner, without any proper reason, the above said petition is kept pending. But it is seen that it was filed only on 14.02.2023. The grievance of the petitioner is that each and every hearing, the learned Judicial Magistrate has insisted the petitioner must pay Rs.1,00,000/- to the respondents. The balance amount to be paid by the petitioner herein / husband is Rs.8,40,000/-.

3. Let the petitioner approach the concerned Court itself, seeking relief in respect of the above said arrear amount to be paid as maintenance. It is submitted that the matter is kept pending without any progress. The petitioner has to pay the balance amount to his wife and children. The petitioner may approach the concerned civil Court for payment of maintenance amount in installments, at his convenience.

4. With the above observation, this Criminal Original Petition is dismissed.
